1.Who we are and acceptance

Flixedin, made up of the website www.flixedin.com and the Flixedin mobile apps (the "Service"), is operated by the company identified in our Legal Notice ("Flixedin", "we", "us").

These Terms of Use (the "Terms") apply to everyone who accesses or uses the Service. By using the Service you accept these Terms. If you do not accept them, do not use the Service.

2.What Flixedin is, and what it is not

Flixedin is an independent information and discovery service about films, cinemas, screenings, live events and the people who make them. It helps the public find out what is showing, where and when, and where to buy a ticket.

Flixedin is not a cinema, distributor, producer, promoter or ticket seller. We do not:

  • distribute, exhibit, broadcast, stream or otherwise make available any film or event;
  • sell tickets, take bookings, set prices or process payments;
  • claim any right in the films, events or works listed. Listing a screening or event is not a claim to hold, license or exercise any right in it.

Unless a page expressly says otherwise, Flixedin is not affiliated with, endorsed by, sponsored by or acting on behalf of any cinema, distributor, rights holder, promoter or ticketing platform shown on the Service.

3.Where our information comes from

Showtime, cinema and event information is compiled from publicly available sources, such as cinema and venue websites, ticketing platforms, official announcements and organisers, and from information sent to us directly. It is factual information about where and when a film or event can be seen.

Where possible we link to the final point of sale, meaning the cinema or the ticketing provider that sells the ticket, so you can book directly with the seller.

5.How listings are ordered

Listings are ordered by criteria such as date and time, location and distance, and relevance to what you searched for or selected.

Where a listing is sponsored, or its position results from payment, it is labelled as such.

6.Accuracy of information

Showtimes, line-ups, venues, prices and availability are set by third parties and can change, be cancelled or be published late or incorrectly at the source.

Information on the Service is provided for general guidance only. We do not guarantee that it is accurate, complete or up to date, and Flixedin is not the authoritative source for any screening or event. Always confirm details with the cinema, venue or ticket seller before buying a ticket or travelling.

7.Third-party names, trademarks and images

Film titles, event names, cinema and company names, logos and trademarks belong to their respective owners. We use them only to identify the film, event, venue or company concerned, in line with honest practice. Their appearance on the Service does not imply any relationship with, or endorsement by, their owners.

If you hold rights in an image shown on the Service and object to its use, send us a notice as described below.

8.Corrections, complaints and removal requests

Cinemas, distributors, promoters, artists and other rights holders can ask us to correct information, add a distributor credit or official link, or remove content they believe is unlawful. To be handled, a request must be sent in writing to contact@flixedin.com and include:

  • the page address (URL) and the exact content concerned;
  • a description of the error, or of the right you believe is infringed and its legal basis;
  • your full name or company name, address and contact details;
  • if you act for a rights holder, proof that you hold or represent the right, and a statement that you are authorised to act;
  • a statement that the information in your request is accurate.

We review complete requests and decide, at our discretion and in line with applicable law, what action if any is appropriate. We may ask for further information or proof before acting. Messages sent through social networks, chat apps or comments are not treated as formal notices.

Sending a request you know to be inaccurate, in order to have lawful content removed, may make you liable under applicable law.

9.Our content and database

The Service, its software, design, our own texts and photographs, and the selection, arrangement and compilation of the information we gather are owned by us or our licensors. They are protected by intellectual property law, including copyright and the sui generis right of the database maker (Articles L.112-3 and L.341-1 et seq. of the French Intellectual Property Code and Directive 96/9/EC).

You may use the Service for your own personal, non-commercial purposes. Without our prior written permission, you may not:

  • extract, scrape, copy or re-use all or a substantial part of the Service or its data, or repeatedly extract insubstantial parts, by automated or manual means;
  • reproduce, republish, sell or commercially exploit any part of the Service;
  • frame or mirror the Service, or present its content as your own;
  • use the Service or its data to build a competing service or to train machine learning models.

We expressly reserve the right to object to text and data mining of the Service under Article 4 of Directive (EU) 2019/790.

10.Accounts, votes and interactions

With an account you can, for example, vote in polls or mark events as "Interested" or "Going". Totals of these interactions may be shown publicly. We may remove votes or interactions that appear fake, automated or abusive.

You can delete your account at any time by contacting us.

11.Acceptable use

You agree not to:

  • use the Service for any unlawful, fraudulent or misleading purpose;
  • interfere with, disrupt or overload the Service, or try to bypass its security;
  • access the Service by bots or other automated means, except ordinary search engine indexing;
  • impersonate any person or organisation, or misrepresent your connection with them;
  • manipulate polls, interest counts or any other interaction.

12.No warranty

The Service is provided free of charge, "as is" and "as available". To the fullest extent permitted by law, we make no warranty of any kind, express or implied, including as to accuracy, availability, fitness for a particular purpose or uninterrupted, error-free operation.

13.Limitation of liability

To the fullest extent permitted by law, we are not liable for:

  • any loss arising from reliance on information shown on the Service;
  • changes, delays or cancellations of screenings or events by cinemas, venues or organisers;
  • any booking, purchase or other dealing with a third party, or the content of third-party sites;
  • any indirect or consequential loss, or loss of profit, revenue, data or opportunity;
  • interruption or unavailability of the Service, or events beyond our reasonable control.

Nothing in these Terms limits or excludes liability for intentional misconduct or gross negligence, for death or personal injury, or any other liability that cannot be limited or excluded by law, including your rights under mandatory consumer protection law.

14.Indemnity

If you use the Service for business or professional purposes, you agree to indemnify Flixedin against claims, losses and reasonable costs, including legal fees, arising from your breach of these Terms or your misuse of the Service.

15.Suspension and termination

We may restrict, suspend or terminate access to the Service or to an account, with or without notice, if we reasonably believe these Terms have been breached, to protect the Service or other users, or where the law requires it. We may change, suspend or discontinue any part of the Service at any time.

16.Changes to these Terms

We may update these Terms, for example to reflect changes to the Service or to the law. The date at the top of this page shows the current version. We may post a notice of material changes on the Service. If you continue to use the Service after an update takes effect, you accept the updated Terms.

17.General

  • If any provision of these Terms is found invalid or unenforceable, the rest remain in full force, and the provision is applied to the fullest extent permitted.
  • If we do not enforce a provision at any time, we do not waive our right to enforce it later.
  • These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service.
  • We may transfer our rights and obligations under these Terms to another company.
  • These Terms are written in English. Any translation is provided for convenience, except where the law requires a version in your language.

18.Governing law and disputes

These Terms are governed by French law. Before taking any legal step, please contact us at contact@flixedin.com so that we can try to resolve the matter amicably.

If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may bring proceedings in the courts of that country. In all other cases, the courts of Paris, France have exclusive jurisdiction.
